Corporate Immigration Pathways to Canada
Facilitating Intra-Company Transfers to Canada
The ICT provides a work permit within the International Mobility Program, providing eligible foreign business owners with the opportunity to relocate certain employees to their enterprises in Canada. The employees must have at least one year of work experience at the sending entity. This pathway facilitates the acquisition of an ICT Work Permit, potentially paving the way for eventual permanent residence (PR). Typically, the principal applicant’s spouse and children become eligible for an open work permit and a study permit, respectively, in the majority of cases.
Coordinating International Movement of Personnel to and from Canada
The ICT program will particularly be attractive to companies with operations in Canada doing similar work.
In addition, managers and other valuable employees of a company that have specialized knowledge which is unique who are currently working overseas can be transferred to a similar position at operations in Canada.
Assisting with Temporary Visas to Canada and Canadian Permanent Residence Applications
Typically, upon completion of one year of full-time work experience in Canada, the foreign national becomes eligible to apply for permanent residence (PR) through the Express Entry program. Depending on the nature of their employment, the individual may qualify for an additional 50 or 200 points by securing arranged employment (a job offer) from the business in Canada.
This typically leads to a noteworthy boost in their Comprehensive Ranking System (CRS) score, potentially resulting in selection under the FWS category of the Express Entry stream and an invitation to apply for permanent residence (PR) from immigration authorities.
Ensuring the Maintenance of Lawful Immigration Status for Employees
Generally, ICTs are issued for a duration of 1-2 years. In the case of foreign workers employed by start-up companies, the work permit is limited to a one-year validity. Conversely, citizens of visa-exempt countries enjoy the advantage of a 3-year work permit. In instances of specialized knowledge, the work permit is renewable for an additional 2-3 years, allowing for a cumulative period of up to 5 years and 7 years for executives and managers.
Managing the Labour Market Impact Assessment Process and Ensuring Compliance with Service Canada Criteria
A Labour Market Impact Assessment (LMIA) may be required for an employer in Canada seeking to hire a foreign worker. An approved LMIA, indicates that the employer is in need of a temporary foreign worker and that no Canadians/permanent residents are available for the position.
LMIA’s are submitted via the Employment and Social Development Canada (ESDC) online portal. This includes programs for high-wage positions, low-wage positions, and seasonal agricultural positions.
