Jain Immigration Law would be delighted to be your student immigration lawyers and assist with your student visas and study permits. Canada is one of the top destinations for international students given the strong reputations of our universities and community colleges. Unlike in many other countries, the most reputable educational institutions in Canada are ‘public’ ones which means they are partially funded by government. Students may work for up to 20 hours while studying (and full-time during school breaks) if they attend a “designated learning institution” and our study permit lawyers can advise on which schools and which programs within those schools qualify for the coveted post-graduation work permit.
Indeed, the vast majority of international students come to Canada so that they may obtain a post-graduate work permit (PGWP) and our PGWP lawyers are very well familiar with how to avoid all the ways PGWPs have been refused in the past given we have appealed many cases in the courts. We know that after obtaining the PGWP, most intend to immigrate as Permanent Residents and then naturalize as Canadian citizens. Many will earn far more in one year than they would have earned in 10 years in their home countries and they enjoy free public health care and free primary and secondary education for their children (and then domestic tuition rates when their children grow up and attend post-secondary institutions). Canada provides safety, security and a bright future given that all labour force growth comes from immigration due to Canada’s aged population and low birth rate. Happily, all major political parties support high levels of immigration and so Canada is faring very well relative to other Western nations.
Another advantage of studying and then immigrating to Canada is that these former students will one day be able to apply to sponsor their parents for Permanent Residence (subject to annual quotas – meaning some will have to try for a few years to fall within the quota).
A Post-Graduation Work Permit (PGWP) allows eligible students to obtain an open work permit so they can gain work experience in Canada.
A lawyer at Jain Immigration Law can help you understand your eligibility, and walk you through your options before applying for the permit, and how you can quality for Permanent Residence after you’ve received the permit. You should avoid private colleges (which tend not to qualify for PGWPs) and one year programs (which allow PGWPs of one year duration only). Two and three year programs lead to a 3 year PGWP.
It is important that your course be logically related to your previous studies and field of work (if applicable). The course should also not be readily available in your home country: pick something with a different angle so you can describe why it’s important for you to study in Canada.
It may be possible to bring your spouse on an open work permit and also your children if we can show how the children will be looked after while you are studying.
It will be critical to show decent previous grades, a proper language score and also the ability of your parents or yourself to finance your education.
Though it is well known that most students wish to ultimately immigrate to Canada, “temporary intent” is technically required and so we must demonstrate decent ties back to your home country.
The Student Direct Stream (SDS) provides for accelerated processing of student visas (a stated 20 days) if the applicant is currently residing in one of these countries:
Antigua and Barbuda, Brazil, China, Colombia, Costa Rica, India, Morocco, Pakistan, Peru, Philippines, Senegal, Saint Vincent and the Grenadines, Trinidad and Tobago, Vietnam.
A Guaranteed Investment Certificate (GIC) of $10,000 is required which means the approved-bank has attested to the availability of the funds and that it holds the funds in an account for the student that is only accessible once the student arrives here.
Also, besides a letter of acceptance from a “Designated Learning Institution,” proof of payment of a full year of tuition for the first year of study is required. A recent transcript, an English Language Testing System (IELTS) score of at least 6 in all four categories (or French Canadian Language Benchmark of 7in each of the four categories) and medicals round out the requirements.
Always apply very early given processing times vary and visa offices are inundated with a high volume of applications in the months just prior to school starting (terms typically start in September and January). The Student Direct Stream takes approximately 20 days but regular processing can be several months.
A work visa allows one to travel to Canada to obtain a work permit which allows for legal work here. A student visa allows one to travel to Canada to obtain a study permit which allows one to study within the parameters listed on the permit.
Study Permits typically last a few months beyond the expected graduation date though they will be limited to when your passport expires. Note that the ability to study in Canada is governed by the Study Permit itself, not the visa which takes up a page in your passport.
If you wish to continue studying, we must apply for a study permit extension prior to the expiry of your current study permit. If you wish to work after graduation, we can assist you with a post graduate open work permit (PGWP) for a reasonable fee and we highly recommend you retain us as we’ve been approached by hundreds of students over the years who made mistakes when applying for the PGWP, putting in jeopardy their path to permanent residence after spending tens of thousands of dollars on their education here.
