IRCC 2026 Update: Continued Work Authorization Under R186(u) While Waiting for Work Permit Renewal

On April 27, 2026, Immigration, Refugees and Citizenship Canada (IRCC) released updated program delivery instructions clarifying how continued work authorization applies under paragraph R186(u) while a work permit renewal is in process. These updates provide clearer guidance for foreign nationals who have applied to extend their work permits and are waiting for a decision.

When an online work permit application is submitted, the Global Case Management System (GCMS) automatically issues a temporary resident acknowledgement of receipt. Since October 20, 2020, GCMS also sends a second letter (IMM 5988 – WP-EXT, excluding post-graduation work permit applicants) confirming that the applicant is authorized to work under R186(u), provided all eligibility requirements are met.

One of the key clarifications in this update relates to the interim proof of work letter. IRCC has confirmed that this letter is issued with a validity period of 365 days. However, it is important to understand that the letter itself does not grant work authorization. Instead, it serves as confirmation that the individual may continue working under R186(u), as long as they continue to meet the applicable conditions.

Work authorization under R186(u) ends if those conditions are no longer met. For example, if a final decision is made on the work permit application, or if the individual leaves Canada, they may no longer be eligible to work under this provision and the letter is no longer valid.

IRCC has also clarified that if a work permit application is still in process after the 365 day validity period shown on the letter, the individual may continue working under R186(u) until a decision is made, provided they continue to meet all requirements. There is no need to contact IRCC or request a second letter.

In addition, the updated instructions introduce a new section addressing situations where a subsequent work permit application is submitted while an earlier application is still being processed. This provides further clarity for applicants with overlapping applications, although the requirement to meet R186(u) conditions at all times remains unchanged.
