Ontario Grants OINP New Power to Return Applications Before Nomination 

On July 1, 2025, the Ontario Immigrant Nominee Program (OINP) has been granted the authority to return submitted applications before a provincial nomination is issues. This is a change that may have significant implications for applicants and representatives.  

This regulatory update, introduced by the Ministry of Labour, Immigration, Training and Skills Development (MLITSD), is part of a broader effort to “better respond to Ontario’s labour market needs” and “protect program integrity.” However, it also introduced new risks and uncertainty for genuine applicants who have invested time and resources into the application process.  

What This Change Means 

The new authority allows the OINP to: 

  • Return an application at any point before a nomination decision is made 
  • Notify the applicant and/or their authorized representative 
  • Issue a refund for the government processing fee only 

Why Is This Happening? 

According to the province, this authority will help ensure applications align with Ontario’s current labour market needs and address program integrity risks. However, the reality appears more complex. Industry observers suggest this policy may be a response to persistent fraudulent activity by unscrupulous immigration consultants, which continues to undermine trust in the system and place legitimate applicants at a disadvantage.  

Unfortunately, rather than directly targeting bad actors, this policy shift introduced broader uncertainty and financial risk for all applicants, including those with strong qualifications and genuine intentions.  

What Should Applicants Do? 

Given this increased discretion on the part of the OINP, it is now more important than ever to ensure: 

  • Your application is thoroughly prepared, accurate and strategically aligned with Ontario’s economic priorities 
  • You are working with a licensed, experienced immigration lawyer, not a consultant, to avoid exposure to misrepresentation or technical errors.  
  • You understand the financial risks associated with submitting an application that could be returned without a full refund of related expenses

Additional July 2025 OINP Changes 

This update was part of a broader set of regulatory reforms, which also include: 

  • The launch of a new Employer Portal, shifting Employer Job Offer streams to an employer-led application process 
  • New in-person interview requirements for employers and applicants (with accommodations where needed) 
  • Revised education criteria for Early Childhood Educators applying through the Human Capital Priorities and French-Speaking Skilled Worker streams
