Work Permit Validity and Passport Expiry: What Foreign Workers Need to Know

Key Regulatory Requirements 
According to Canada’s Immigration and Refugee Protection Regulations (IRPR), specifically Section R52, a foreign national must hold a passport valid for the entire duration of their stay in Canada. This directly impacts the validity period of work permits issued by Immigration, Refugees and Citizenship Canada (IRCC). 

Work Permit Issuance Based on Passport Validity 
When an employer secures a Labour Market Impact Assessment (LMIA) specifying a work duration, IRCC officers typically issue work permits that match this period, provided the applicant’s passport remains valid for the entire term. If a foreign national’s passport expires before the end date on the LMIA, the work permit will only be issued until the passport’s expiry date. 

For example, if the LMIA authorizes two years of employment but the passport expires in one year, the officer will issue a one-year work permit. 

Renewal of Work Permits Without a New LMIA 

Importantly, if the initial work permit was shortened only because of passport expiry, foreign nationals can apply to renew their work permit once they obtain a passport with extended validity. This renewal does not require a new LMIA, even if the LMIA validity has lapsed. The renewal is calculated based on the original LMIA conditions and the date of the foreign national’s initial entry into Canada. 

Documentation and Transparency in Processing 
IRCC officers are required to document in the case management system the reasons for issuing a work permit for a shorter duration than indicated in the LMIA. This transparency ensures clarity for applicants and employers alike.
